Terms and Conditions
The ground rules.
These terms cover the Pangisha website, admin portal, tenant portal, app-like tenant experience, billing tools, payment flows, messages and support.
Effective date: 18 June 2026. In these terms, "Pangisha", "we", "us" and "our" mean the Pangisha property management platform operated by G&G Marketing or its authorised operator. "Customer" means a landlord, property manager, property company or admin account holder. "Tenant" means someone invited or validated to use a tenant portal.
1. Agreement
By using Pangisha, creating an account, signing in as a tenant, sending a contact request, making a payment or continuing to use the service after we update these terms, you agree to these Terms and the other policies in the Legal Centre.
If you use Pangisha for a business, building, landlord or property team, you confirm that you have permission to do that and to manage the related property, tenant, payment and communication records.
2. What Pangisha Does
Pangisha is a cloud property management system for tenant records, rent tracking, notices, messages, invoices, payment workflows, subscription administration and portfolio reporting.
Pangisha is not your landlord, tenant, agent, advocate, accountant, tax adviser, bank, escrow service or payment processor. We do not decide whether rent is owed, whether a notice is valid, whether a tenancy should end, or whether a tenant should be approved. Those decisions stay with the Customer.
3. Accounts and Roles
- Customers must keep account, billing, building, unit and contact details accurate.
- Customers are responsible for their admins, staff, agents and activity inside their workspace.
- Tenants must provide accurate identity, phone, email, unit and password details when signing up or resetting access.
- Customers must only enter tenant data they are allowed to process, and should keep it accurate, relevant and necessary.
- Everyone must protect passwords, OTPs and active sessions. Tell us quickly at info@ggmarketing.co.ke if something looks wrong.
4. Subscriptions and Feature Access
Admin features depend on the active package, unit limits, payment status and account standing. We may limit, suspend or downgrade features if fees are overdue, a plan limit is exceeded, an account is suspended, or use creates a legal, security or operational risk.
The package shown on the website, invoice or order form controls what is included. Custom enterprise terms only override these Terms when agreed in writing.
5. Payments Through the Platform
Pangisha may connect Customers and Tenants to payment options such as M-Pesa STK Push and card payments through Paystack. Those providers process transactions under their own rules, security checks and settlement timelines.
- Pangisha does not store full card numbers, CVV codes or mobile money PINs.
- Payment status depends on provider confirmations, callbacks, verification checks and network availability.
- Customers are responsible for reconciling rent balances, refunds, reversals, chargebacks and tenant account credits.
- Provider fees, bank fees, failed transaction costs, reversals and taxes may apply.
6. Notices, Messages and Communications
Pangisha may let Customers send notices, invoices, payment reminders, tenant replies, OTP messages and other communication. Customers are responsible for what they send, who they send it to, when they send it, and whether it is legally valid.
You must not use Pangisha to harass, threaten, mislead, defame, spam, impersonate or unlawfully evict anyone. Delivery depends on email, mobile, payment and messaging networks, so it cannot be guaranteed every time.
7. Customer Data and Privacy
For tenant, building, lease, rent and portfolio records uploaded by a Customer, the Customer usually controls the data and Pangisha processes it to provide the service. For Pangisha account administration, billing, security, support, product analytics and our own customer relationships, Pangisha may handle data as an independent controller.
Our Privacy Policy and Data Processing Addendum explain these roles and are incorporated into these Terms.
8. Acceptable Use
You must follow the Acceptable Use Policy. Do not interfere with the service, try to access another workspace, bypass subscription limits, upload malware, abuse payments, send unlawful messages, scrape data, reverse engineer the platform, or use Pangisha to break the law.
9. Availability, Support and Changes
We work to keep Pangisha available and secure, but maintenance, upgrades, internet issues, provider outages, security incidents or events outside our control can interrupt the service. We may update, improve, replace or remove features, and we will handle major changes reasonably for active Customers.
10. Intellectual Property
Pangisha, including its software, designs, text, workflows, logos, screenshots and documentation, belongs to Pangisha, G&G Marketing or their licensors. Customers keep ownership of their Customer Data. You give us the limited permission we need to host, process, display, secure and support that data as part of the service.
11. Suspension and Termination
We may suspend or terminate access if fees are unpaid, these Terms are breached, the law requires it, your use threatens the service, or we reasonably believe the account is being misused. Customers may cancel under the Billing, Cancellation and Refund Policy.
After termination, we may retain or delete data according to the Privacy Policy and Data Retention and Deletion Policy.
12. Disclaimers and Liability
Pangisha is provided on an "as is" and "as available" basis, as far as the law allows. We do not promise that the service will always be uninterrupted, error-free, compatible with every device, or that every third-party payment, email or messaging provider will complete every transaction or delivery.
As far as the law allows, Pangisha will not be liable for indirect, special, punitive, incidental or consequential loss, including lost profits, lost rent, business interruption, reputational harm or data loss. Our total liability for service-related claims is limited to the fees the Customer paid for the service in the three months before the event that caused the claim, unless the law requires otherwise.
13. Indemnity
Customers agree to protect Pangisha from claims, losses and expenses that come from Customer Data, tenancy decisions, unlawful notices, misuse of messages, payment disputes, breach of these Terms, or unlawful conduct by the Customer or its users.
14. Governing Law and Disputes
These Terms are governed by the laws of Kenya. We will first try to resolve disputes in good faith. If that fails, the dispute may be referred to mediation in Nairobi, Kenya, before either side goes to court, unless urgent protective relief is needed.
